Terms of Service

Welcome to Prost, the social app for nights out with friends. Prost lets you start a shared night session with your crew, capture the evening in real time, and turn it into a morning-after Recap card to keep and share.
By downloading Prost, creating an account, or using the app, you agree to these Terms of Use. If you do not agree, please do not use Prost.
1. About Prost

Prost is structured around three core pillars:
- The Night: a live, shared session where you and your crew see each other on the map, stamp venues, capture photos, chat, and take on sidequests together in real time.
- The Recap: a morning-after card automatically generated from your night’s data, designed to be shared to Instagram Stories and other platforms.
- The Hub: your personal profile: an archive of past Recap cards, personal stats, and a friends leaderboard.
2. Eligibility
To use Prost, you must:
- Be at least 18 years of age. Prost is an adult platform built around nightlife culture. We do not knowingly permit users under 18.
- Be able to form a binding contract under the law that applies to you.
- Not be prohibited from using the service under any applicable law or regulation.
By creating an account, you represent and warrant that you meet all of the above. If we discover that a user is under 18, we will terminate their account and delete their data without notice.
3. Your account
3.1 Registration
Prost uses Sign in with Google on all platforms and Sign in with Apple on iOS for authentication. No password is required. You are responsible for keeping your device and sign-in credentials secure.
3.2 Username
During onboarding you choose a username. Your username is your identity within Prost. Do not choose a username that impersonates another person or organisation.
3.3 One account per person
Each person may hold one Prost account. Creating duplicate accounts, for example, to circumvent a ban, is not permitted and may result in all associated accounts being terminated.
3.4 Account security
If you believe your account has been compromised, notify us immediately at support@prosts.net.
4. Using Prost
4.1 Sessions (The Night)
You may start a Night session at any time. Each session generates a shareable link and QR code, the primary way to invite friends. The session web preview is publicly accessible to anyone with the link, even without the app, and displays the session name, current venue, participant names, venues visited, and session photos.
By starting or joining a session, you acknowledge that:
- Session data (photos, venue stamps, chat, sidequest content, participant list, and your live location while the session is active) is visible to all session participants in real time.
- The session web preview is accessible to anyone who receives the session link.
- You are responsible for the content you contribute to a session.
4.2 Alcohol & responsibility
Prost is a social memory product set in nightlife culture. It does not measure, track, or encourage alcohol consumption, and it is not a health or safety tool. Please drink responsibly and be aware of local laws regarding the purchase and consumption of alcohol. Prost accepts no liability for harm caused by alcohol consumption.
4.3 The Prost Camera
The in-app camera stamps photos with the time and venue name (sourced from Google Places). Photos attach automatically to your active session. By using the Prost Camera, you grant us permission to access your device camera and location at the moment of capture.
4.4 Sidequests
During a session, Prost may offer sidequests, playful challenges completed by capturing photo or video proof that your session participants then confirm or reject. Sidequest media is session content and is treated like any other content you contribute (see Section 5). Completed quests may appear on your Recap card.
4.5 The Recap card
When your session ends, Prost generates a draft Recap card that you can curate and publish. All published Recap cards include a Prost watermark and a QR code linking to the session web preview. These elements are non-removable and form part of Prost’s organic sharing mechanism.
4.6 Leaderboard, achievements & following
The leaderboard ranks users by nights out and unique venues visited, weekly and all-time, among friends or globally. Participation is strictly opt-in via Settings. Rankings are never based on drink volume. Prost also awards achievements for milestones (nights out, venues, streaks, Stammgast venue loyalty) and lets you follow other users, with follow requests for non-public profiles.
5. Your content
5.1 Ownership and licence
You own the photos and content you contribute to Prost. By posting content, you grant Prost a non-exclusive, royalty-free, worldwide, sublicensable licence to store, display, and distribute your content within the app and in session web previews, solely for the purpose of operating the service.
5.2 Your responsibility
You are solely responsible for all content you post, photograph, or share through Prost. You warrant that you have the right to post any content you contribute and that it does not violate the rights of any third party, including the privacy rights of people who appear in your photos.
5.3 Content removal and deletion
You may delete your Recap cards, photos, or entire sessions at any time from within the app. We reserve the right to remove any content that violates these Terms without prior notice.
6. Objectionable content & abusive users, zero tolerance
Prost has zero tolerance for objectionable content and abusive users. There is no place on Prost for harassment, hate speech, sexual exploitation, threats, or any content that targets or endangers others.
To keep Prost safe, the app provides:
- Reporting: you can report any user or content from within the app (categories include spam, harassment, hate speech, nudity or sexual content, violence or threats, and self-harm).
- Blocking: you can block any user instantly. Blocked users cannot interact with you.
- Moderation: we review reports and act on objectionable content, including removing content and ejecting offending users. We aim to act on reports of objectionable content within 24 hours.
You agree not to use Prost to:
- Post content that is unlawful, harmful, harassing, defamatory, hateful, discriminatory, or sexually exploitative.
- Impersonate any person or organisation, or misrepresent your identity.
- Share false information or content designed to deceive others.
- Harass, bully, threaten, or intimidate other users.
- Post content that infringes on any intellectual property rights.
- Distribute spam, unsolicited messages, or malicious code.
- Attempt to gain unauthorised access to Prost’s systems or another user’s account.
- Scrape, extract, or harvest data from Prost without our express written permission.
- Use Prost in any way that facilitates or promotes illegal activity.
- Circumvent, disable, or interfere with any security features of the app.
Violations may result in content removal, account suspension, or permanent termination, at our sole discretion. See our Community Guidelines for full content rules.
7. Privacy & data protection
Prost is operated from Germany and complies with the EU General Data Protection Regulation (GDPR). Our Privacy Policy explains in detail what data we collect, how we use it, and your rights as a data subject, including your right to delete your account and all associated data at any time (how to delete your account). We do not sell, rent, or trade your personal data.
8. Intellectual property
8.1 Prost’s IP
All Prost branding, software, design, visual assets, and product names are owned by or licensed to us. You may not copy, reverse-engineer, modify, or distribute any part of the Prost platform without our explicit written consent.
8.2 Recap card branding
Exported Recap cards include a Prost wordmark and QR code. These elements are a permanent part of the card design. By exporting and sharing a Recap card, you agree to share it with the Prost branding intact.
8.3 Third-party services
Prost uses the Google Places API for venue data, subject to Google’s Terms of Service. Prost is not affiliated with or endorsed by Google, Apple, Instagram, WhatsApp, or any other platform.
9. Disclaimers
Prost is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including that the app will be uninterrupted, error-free, or available at all times; that session web previews, venue data, or Recap cards will be accurate or complete; or that the app is fit for any specific purpose.
Prost is a social memory product, not a safety tool. It is not a substitute for your own judgment about alcohol, your safety, or your personal wellbeing. If you or someone around you needs help, contact emergency services.
10. Limitation of liability
To the maximum extent permitted by applicable law, Prost and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app; any content posted by other users; any data loss, including photos or session data; or any harm caused by alcohol or nightlife activities in connection with your use of Prost.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under German or EU law.
11. Termination
11.1 By you
You may stop using Prost and delete your account at any time from the Profile tab (see account deletion).
11.2 By us
We may suspend or permanently terminate your account if you violate these Terms, engage in harmful or abusive behaviour, or for any other reason at our discretion. Where possible we will give notice, but we are not obligated to in cases of serious or repeated violations.
12. Changes to these Terms
We may update these Terms as the product evolves. For material changes, we will notify you via in-app notification or email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance. The current version is always available at prosts.net/terms.
13. Governing law & disputes
These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of law provisions. Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Bremen, Germany.
We encourage you to contact us first at support@prosts.net to resolve any issue informally. As an EU consumer, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
